- Incentive Conditions of Entry
1. Information on “how to enter” the nbn® Academy Program’ promotion ("the Program") and incentives form part of these Conditions of Entry. Participation in the promotion is deemed acceptance of these Conditions of Entry. In the event of any discrepancy between Program information material and the following terms and conditions, these terms and conditions will apply.
2. The Program Administrator is CROSSMARK Australia Pty Limited ABN 38 111 971 021
3. nbn co ltd ABN 86 136 533 741 (“nbn”) has provided the eLearning materials for this Program and will assist the Program Administrator to validate successful completion of the training.
4. Entry to the promotion is open to all residents of Australia, India, Sri Lanka, and the Philippines who are a Participant as defined in clause 7. Persons employed by agencies associated with this promotion and their immediate families and employees of the promoter and their immediate families are not eligible to enter the promotion.
5. Information regarding the “promotion period” will be published via nbn Operations Bulletin including start dates, end dates and other key information.
6. The Program Administrator reserves the right to suspend or terminate the program at any time they deem appropriate.
7. A “Participant” is a current employee of a Retail Service Provider customer (RSP) of nbn where the RSP has entered into a Wholesale Broadband Agreement with nbn that remains in effect and the employee has registered for the promotion.
8. Once a Participant has registered for the promotion, he/she shall be known as a participant in the promotion.
9. By registering for the Program, each Participant consents to the information they submit on their registration form being entered into the Program database and being used by nbn and the Program Administrator for the purpose of managing and administering the Program.
10. The Program Administrator reserves the right to verify the validity of the Participants.
11. Participants may be entitled to incentive rewards from time to time as published in nbn Operations Bulletin. Any incentive rewards will be subject to the below conditions: a. The maximum incentive reward a Participant can earn in relation to the nbn Academy modules is as stipulated in the nbn Operations Bulletin. b. Participants must successfully complete the modules within the timelines specified. c. Participants can only be rewarded once for successfully completing the requisite modules in a curriculum. d. Incentive rewards will be allocated to Participants from the total module incentive reward pool upon each successful completion of the module curriculums in accordance with these terms and conditions e. the Program Administrator reserves the right to extend incentive reward earning opportunities within the Program.
12. In the event of any incentive rewards, the dispatch of such rewards will be subject to the following: a. Incentive rewards become redeemable when nbn and / or the Program Administrator have validated the quiz completions, including validation of the Participant’s email address and RSP store location details. b. module results can be viewed on the Program website c. The Program Administrator’s decision on module completion is final and no correspondence will be entered into. d. A Participant’s incentive reward cannot be transferred to another Participant or entity. E. The incentive reward earned in the Program will expire, or be forfeited, under the following conditions: i.
The reward becomes 'redeemable', and has not been claimed by the end date as published. ii. Participant’s email addresses or RSP store location details cannot be validated. iii. The Participant is no longer employed by an RSP before the incentive reward has been redeemed. f. Incentive rewards earnt are subject to an audit at the discretion of the Program Administrator, both during or subsequent to the completion of the Program. If a violation of these terms and conditions is found during an audit, the offending Participant will, without limiting the Program Administrator’s rights, have their registration terminated and all applicable incentive rewards forfeited.
13. Any incentive rewards must be taken as offered. The incentive reward is not transferable or exchangeable and cannot be taken as cash. If the prize is unavailable, for whatever reason, the Program Administrator reserves the right to substitute the incentive reward for an incentive reward of equal value.
14. The Program Administrator and their associated agencies, and companies associated with this promotion will take no responsibility for incentive rewards damaged or lost in transit.
15. Any dispute concerning goods received as an incentive reward shall be settled between the Participant and the merchant and/or supplier nominated by the Program Administrator in respect of the relevant services. To the maximum extent possible at law, the Program Administrator will bear no responsibility for resolving such disputes or for the defect or complaint which is the subject of the dispute.
16. If for any reason the promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes which are beyond the control of the Program Administrator which corrupt or affect the administration security, fairness, integrity or proper conduct of the Program, the Program Administrator may suspend or end the Program.
17. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Program Administrator may in its absolute discretion cancel the event and recommence it from the start on the same conditions subject to subject to approval of relevant regulatory authorities
18. The Program Administrator is not responsible for any error, omission, interruption, deletion, defect in operation or transmission, communications line failure, theft, destruction or unauthorised access to, or alteration of entries occurring in relation to the conduct of the promotion. Additionally, the Program Administrator accepts no responsibility for any message not received by the Program Administrator or delays in the delivery of the message due to technical disruptions or for any other reason (including, without limitation, any failure or delay by a carriage service provider in delivery of any message sent in relation to the Program).
19. Program and personal liability a. nbn and the Program Administrator shall not be liable, and each Participant shall release nbn and the Program Administrator from liability, for any loss or damage whatsoever suffered (including, but not limited to, indirect or consequential loss) or personal injury suffered or sustained as result of incentive rewards claimed, except for any liability which cannot be excluded by law, in which case that liability will be limited to the minimum amount permitted by law. b. Liability for a Tax (including any applicable fringe benefits tax (“FBT”) on any incentives provided to Participants in this Program is the sole responsibility of the Participant. Participants should contact their accountant or taxation adviser in regard to FBT and all associated tax matters.
20. Privacy a. In this clause "Confidential Information" means information collected on Participants in relation to the Program. b. Parties agree to treat Confidential Information as secret and confidential. In particular and without limitation, the Program Administrator shall put in place reasonable security measures to ensure that no third party gains access to any online or website information provided c. Program Administrator will not use Confidential Information for any purpose other than the performance of its obligations pursuant to the Program. d. Program Administrator will restrict the disclosure of Confidential Information to nbn and those of its employees and other professional suppliers who require Confidential Information to perform its obligations in the Program.
21. These Conditions of Entry will be governed by the laws of New South Wales, Australia and the parties irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia and Commonwealth courts with jurisdiction in that state.
